We had a bit of a scare over the week-end. It started out on the comical, odd side and went directly to deeply confused. And it all boils down to the recent foreclosures we've all been hearing about.
Let me tell you, I never, ever expected to become involved in a foreclosure. We have always paid our bills on time--both before we were married and together afterward. Our mortgage is up to date; no missed payments, no late payments.
Now, fast forward to this week-end. I was going through the mail and came across a letter addressed to "Jane and John Doe" at our address. I had to laugh. "Jane?" Who's that? "John Doe?" What in the world is going on here? The sender is a lawyer. What lawyer would be sending out prank mail? It's not addressed to me but I have got to open this to see what could be inside.
And it was a very good thing I did too! It was a copy of an official court order granting possession of our home and property to some bank. This isn't our bank! Besides, I know we're up to date on our payments. What in the world?!!! How can they do this? We closed on this house in June. We have all our papers including the free and clear title statement and the deed. How can some judge take our home away from us? And just before Thanksgiving?
Well, to cut a long story short, we contacted our realtor who remains a good friend of ours and she set the ball rolling. She informed the sellers and their attorney of the situation and, thankfully, they are good-hearted, kind people. Their attorney took it upon himself to resolve this situation for us. (Now, I know the name of a good lawyer!)
He contacted the attorney for the bank and got her to admit that a mistake was made and we should never have received the notice. She claims the eviction will not proceed. Phew! But I'm not sure I trust her. She wants us to just disregard the whole thing. But there's still this court order granting possession of our home to the bank. Somehow, that just doesn't seem right to me. What do you think?

I think you did right by contacting your realtor and do hope you wrote down the date, time and who you talked with over this matter. Mistakes do happen but you sure don't want anything like that to actually happen.
Our son had received a letter from his mortgage company telling him he owed past payments. After a few phone calls and a bit of rage, he finally found out that they were applying his payments to a different account. Needless to say, he found another mortgage company! He wasn't a happy camper on this "mistake." Also think he gained a few grey hairs over this...ugh!
Hopefully this problem has been settled and you won't receive any further unwelcome letters.
Wow this is insane. I sure hope you have all of this information documented. Just Like Deb said, write it all down.
